The central government has proposed to enhance the jail term for those who abandon or abuse their elderly parents to six months from the existing three months, according to a senior official.
“Along with reviewing the Maintenance and Welfare of Parents and Senior Citizen Act, 2007, The Ministry of Social Justice has also proposed to widen the definition of children to include adopted children or stepchildren, sons-in-law, and daughters-in-law, grandchildren and minors represented by their legal guardians,” a senior official said in a statement.
In the existing Act, only biological children and grandchildren are included.
The official further added, “In the proposed act the central government also demands, instead of the upper limit (10,000 a month in maintenance) make it variable. For e.g. those who earn well can and should shell out higher amounts for the upkeep of their parents. The central govt also wants that ‘maintenance’ also includes safety and security of parents along with providing food, clothing, housing, and healthcare”.
If in case their children neglect or refuse to take care of them, elderly parents can approach a maintenance tribunal.
